Programme Objective

Singapore has adopted the “rights-based” approach in determining the characterisation of software payments in February 2013.  How is this approach different from the previous IRAS’ position? Have all issues pertaining to software tax characterisation been satisfactorily resolved as a direct result of adopting the new approach? In what ways would the software payments not be subject to any withholding tax in Singapore?

In this module, participants will have the opportunity to better understand some common software tax characterisation issues so that they know what types of software payments will continue to attract withholding tax under the new approach as adopted in February 2013. The use of practical case studies and interactive discussions between the workshop facilitator and the participants would form a major component in this workshop to ensure that the discussion and key learning points remain practical and relevant.
 

Programme Outline

  • Identify common types of software payments and evaluate the Singapore tax implications for making each of these types of software payments to non-residents
  • Review the OECD’s rights-based approach in software tax characterisation as adopted by the IRAS
  • Examine the software tax characterisation issues that remain unresolved despite the adoption of the Rights-based approach by the IRAS.
  • Discuss briefly the latest development in the international tax arena on this topic
