Programme Objective
 
This workshop aims to provide participants with a good understanding of the key issues and considerations from a corporate tax, transfer pricing and GST perspective for businesses engaged in cross-border transactions. Participants will learn latest updates on international tax, transfer pricing and the Goods and Services Tax (GST) guidelines on when a Business Establishment (BE) or Fixed Establishment (FE) is created for Singapore GST purposes. This workshop will also provide Participants with actual case studies and examples enabling opportunities for discussions.

  • Introduction – Singapore tax system
  • Concept of Permanent Establishment (PE) – Understanding the basic concept and how it is defined under the Taxation Treaties
  • Impact of BEPS project on preventing artificial avoidance of PE’s
    1. PE presence
    2. Capital & profit allocation
  • Principal purpose test in the BEPS Multilateral Convention
    1. Understand how the test operates
    2. Issue addressed through the principal purpose test by analysing examples
  • Concept of BE and FE for Singapore GST purposes and how to determine the belonging status of suppliers/customers
  • Understanding what qualifies as “international services” and how to apply the provisions in the GST Act for zero-rating of services
  • Export of goods and documentation requirements supporting the zero-rating treatment
  • Common misconceptions in applying the GST treatment for “international services” and export of goods
  • Question and answer

Harsh Shah

Harsh is a Director and Leader of the Transfer Pricing team in a tax consultancy firm.
 
Harsh has a very strong understanding of international taxation and specialises in advising clients on issues regarding transfer pricing, permanent establishment, profit attributions, withholding taxes, etc.  Harsh has advised several multinational clients in developing tax and transfer pricing efficient strategies including documentation, obtaining advance rulings, negotiating bilateral advance pricing agreements, obtaining cross border tax relief under mutual agreement procedure and in structuring investments inbound to India.
 
Harsh is a Chartered Accountant and has been advising clients on transfer pricing and international tax issues over the past 11 years. Prior to joining his current firm, he was a manager with a Big 4 international accounting firm in Singapore.
 
Harsh is a member of Institute of Chartered Accountants of India and International Fiscal Association.
 

Yvonne Chua
ATA (GST)
 

Yvonne is an Associate Director of a dedicated GST team in a tax consultancy firm. She has over 19 years of specialist experience as a GST regulator and advisor.

She was previously with the Inland Revenue Authority of Singapore (IRAS) for over 7 years and advised taxpayers on GST matters. She has extensive experience in GST advisory work for various industries and was also a speaker and panelist for the GST classes conducted by the IRAS.

Yvonne left the IRAS to join a Big 4 international accounting firm where she provides the full suite of GST compliance and advisory services to clients (largely MNCs) in various industries, including those in retail, manufacturing, technology, semi-conductor, pharmaceutical and financial services for over 9 years. Yvonne also conducted trainings for clients and spoke at GST seminars.

Her experience also includes advising and supporting clients on dispute analysis and resolution matters arising from tax investigations and tax audits conducted by the IRAS and has extensive experience in dealing with the IRAS.
